New levy regulations set out arrangements for 'misapplied' receipts

Parish councils which do not use Community Infrastructure Levy (CIL) receipts to support the development of their areas could have to repay the funding, draft regulations for the regime propose.

The draft regulations, just published by the Department for Communities and Local Government, sets out the detail of the proposed new regime. It includes provision that where there is a neighbourhood development plan in place, “or permission granted by a neighbourhood development order (including by a community right to build order)“ the charging authority must pass 25 per cent of the CIL funds to the parish councils in whose area the chargeable development takes place.

Where there is no neighbourhood development plan this amount would be 15 per cent, subject to a cap of £100 per household in the parish council area per year, according to the draft regulations.

In Wales, the charging authority must pass 15 per cent of levy funds to the community councils in whose area the chargeable development takes place. A similar cap would apply.

The draft regulations state that a parish council must use the CIL receipts passed to it to support the development of its area by funding "the provision, improvement, replacement, operation or maintenance of infrastructure", or "anything else that is concerned with addressing the demands that development places on an area".

The draft regulations say the charging authorities would be able to recover funds from the local council in "certain circumstances".

The explanatory notes to the draft regulations said these circumstances would occur "if the local council has misapplied the CIL by not using it to support the development of their area or by using it for another purposes”.

The notes added: "When levy receipts are recovered from a local council, the charging authority must use those funds to support development in the area of that local council."

The good news is that Greenhithe Marina (Management) are not quitting on their vision to provide a first class marina development for the Greenhithe community.

The best news is that they want your views on their latest proposal which will include:
  • Improved access to the River via a new riverside Boardwalk
  • Observation deck and viewing platform
  • New community facilities to include member’s yacht club with clubhouse and possible bar and food
  • Local residents to receive discount on yacht club membership
  • Secure controlled access to the marina at all times
  • Up to 200 walk-on pontoon berths with deepwater fueling facilities and waste collection by river only
  • Dedicated Marina Parking for around 120 -150 cars  

And ..... 


Provided there is local interest and up-take the developers would also like to include.

  • A new nautical training centre where local people and visitors can learn how to sail
  • Local history museum, this could be anything from pictures and artefacts displayed on the clubhouse walls to a small feature and display area
  • River bus service connection to London Bridge with facilities for people using the river taxi service
  • Fisherman Wharf, an area where locals can fish
  • A youth dingy and sailing club for under 25s
  • Discounted family and student memberships

East Coast - LSC RYA Day Skipper Practical

Sailing Miles an East Coast RYA Training Centre is offering GMRA members of the London Sailing Club a special rate to complete the Day Skipper Practical Course.

Cost to GMRA members of LSC: £450 per crew as long as a minimum of 3 members take up the offer. The price includes all food, accommodation, marina fees, fuel and tuition. Only additional costs will be any meals and drinks you decide to take ashore.

This course is for those with some sailing experience who would like to learn how to take on the responsibility of skippering and navigating a yacht safely on short passages in tidal waters.

On satisfactory completion of the course you'll receive an RYA Day Skipper Practical certificate.
  • During the course you will learn how to:
  • Prepare a yacht ready for a sea passage
  • Check a yachts engine and equipment for serviceability
  • Apply the sailing rules of the road
  • Plan short passages
  • Navigate and pilot a yacht during daylight and night hours
  • Handle a yacht both under power and sail on open water and when berthing
  • Manage and communicate with other crew members

Prerequisites: 5 days and 100 miles sailing on board a yacht including at least 4 night hours. You must have basic navigation skills to the level of Day Skipper Theory, and be able to helm.

  • Duration: The course will be run over 5 days with overnight accommodation on board the yacht. 
  • Joining the boat on Friday night at Bradwell marina. 
  • Trains can be taken from Liverpool Street to Southminster, where a member of LSC will collect you and transfer you to the boat by car.
Outcome: This course prepares you to skipper a pleasure yacht on short passages in tidal waters. Your knowledge and sailing experience will be recognised by the issuing of a course completion certificate.

Progression: This course prepares you for the RYA Coastal Skipper/Yachtmaster Theory Course, and with a few more sailing miles under your belt, onto the RYA Coastal Skipper Practical Course.

Two opportunities are now available to become a Town Councillor.

 
EXCITING OPPORTUNITIES AVAILABLE TO BECOME A TOWN COUNCILLOR!
 
 
Two notices of vacancies were recently advertised, providing electors from the Knockhall Ward and the Swanscombe Ward with 14 days to write to request a by-election be held to fill the vacancies. No such requests were forthcoming, entitling the Town Council to now fill the vacancies by co-option.
 
Written expressions of interest are now invited from local residents who wish to be considered as a prospective Town Councillor to fill the vacancies at either Knockhall Ward or Swanscombe Ward. The role of a Town Councillor is very varied and interesting and hugely rewarding given the size, strategic position and importance of the Town.
 
To be eligible as a Town Councillor you have to be:
 
A British, Commonwealth, or European Union citizen; over 18 and on the Electoral Register. In addition you must have lived, worked or occupied as owner or tenant any land or other premises in, or within three miles of, the parish for at least 12 months.

Statements should outline the skills, experience, commitment and knowledge that individuals would bring to the council to benefit the community of Swanscombe and Greenhithe Town. Statements should also clearly state which vacancy they are referring to, either Knockhall Ward or Swanscombe Ward.

Deadline for receipt of submissions is 8 February 2013. Interested parties will be invited to attend the Town Council meeting on 21 February 2013 at which a majority vote will take place to determine the co-opted member.

Invitation to a Public Exhibition of proposed Development at Eastern Quarry Swanscombe

LAND SECURITIES WOULD LIKE TO COMMENCE RESIDENTIAL DEVELOPMENT AT EASTERN QUARRY TO PROVIDE NEW HOMES AND COMMUNITY FACILITIES, FOLLOWING THE COMPLETION OF MINERAL EXTRACTION ACTIVITIES.

Planning permission was granted in November 2007 for the development of Eastern Quarry to provide 6,250 dwellings and in addition up to 231,000 sqm of floorspace for non-residential uses.


1) Development Parameters & Site Wide Masterplan
Given the changes to the housing market since planning permission was first granted, Land Securities has sought approval from Dartford Borough Council (DBC) to amend the approved scheme. The principle changes proposed are for the following:

• to enable a first phase of development to come forward in the Eastern Gateway Area;
• to provide residential development in the Eastern Gateway Area;
• to redistribute employment floorspace, into the Central Village and Western Hub; and
• re-position the Primary School Site at the centre of Castle Hill.

2) Area Masterplan & Area Design Code In compliance with conditions on the outline planning permission Land Securities is preparing an Area Masterplan and Design Code for parts of the East Village/Castle Hill area, which will be submitted to DBC in early 2013. Once approved, this will enable the reserved matters for the first phase of residential development to be submitted for approval.

3) Local Park
A new local park is proposed to be provided in the Eastern Gateway Area adjacent to Southfleet Road, for use by new and existing local residents.

From 28 January 2013 Arriva will be making a significant change to the 495 Bus Service. The 495 currently runs half hourly during the daytime Mondays to Saturdays between Pepper Hill, Sainsburys and Kings Farm, Gravesend, via Perry Street and Gravesend town centre. Arriva will be extending the service to Bluewater via Springhead Park (where the service will spur into the Springhead Park development), Ebbsfleet Intrernational Railway Station, Southfleet Road, Swanscombe Street, Gunn Road, Bodle Avenue, Manor Road and Alkerden Lane.
